Conditions of Participation in Competitions

1. Introduction

Latch GmbH (“Latch“, “We“) can offer various competitions itself or in cooperation with partners. Depending on the competition, Latch can act on its own or with one or more cooperation partners. The party responsible for the implementation of the competition is hereinafter referred to as “Operator“. These Conditions of Participation apply to the implementation of and participation in competitions.

2. Eligibility to participate

Unless otherwise stated, all persons over the age of 18 are eligible to participate.
Unless otherwise stated, only persons with a user account with the Loviz Dating App from Latch are eligible to participate.
All information provided by the participant must be truthful.
Participants must be resident in Switzerland. Persons not resident in Switzerland are not eligible to participate.
Participants may only participate on their own behalf and not on behalf of another person.
Latch employees are excluded from the competition.

3. Prize draw

Latch organizes the competitions either on its own or in cooperation with partners.
You can take part in the competitions in accordance with the requirements described in the respective competitions (e.g. by posting a post on social media in which We are marked, by completing a quiz)
In order to take part in competitions, participants must accept these Conditions of Participation. Further terms and conditions (e.g. rules of the game) may apply to individual competitions. By participating, participants accept all applicable terms and conditions (including the Conditions of Participation).

4. Exclusion

The Operator reserves the right to exclude the person concerned from the competition in the event of a breach of the Conditions of Participation or the other applicable terms and conditions.
Persons who use unauthorized aids or have gained an advantage through manipulation will be excluded from the competition. Any winnings may subsequently be disallowed and reclaimed.

5. Implementation

Competitions are organized by the Operator. The competitions are based on a random draw. The Operator is solely responsible for the conditions of the draw.
The closing date for entries is stated for each competition.
The Operator reserves the right to cancel or terminate any competition at any time and without prior notice. The Operator shall exercise this right, among other things, if the proper execution of the competition can no longer be guaranteed due to legal, technical or organizational reasons. If such a termination was caused by the behavior of participating persons, the Operator may demand that the persons concerned compensate the Operator for the damage incurred.
The delivery conditions of the prizes are stated in the respective competitions.
Winners will be notified by the Operator or its cooperation partners.
The Operator reserves the right to publish the name or pictures of the winners on the website or the social media channels of the Operator. The winners expressly agree to this type of publication.
The Operator may forward the winners’ data to its cooperation partners to enable the delivery of the prize.
Any cash prizes will be sent to the winners by bank transfer. Once the transfer has been made, the Operator is released from its obligation to perform/ obligation to provide indemnification. If a transfer cannot be carried out due to circumstances and reasons over which the Operator has no control or is not responsible, the prize and all claims against the Operator shall be forfeited.
If the prize has to be collected by the winners themselves, the company responsible for delivering the prize will be named to the winners. If winners do not collect the prize from the relevant company within the specified period, the prize and all claims against the Operator will be forfeited. All costs for collection, transportation and any subsequent costs (e.g. repair, insurance) shall be borne by the winners themselves.
Under certain circumstances, travel winnings can be handled entirely by tour operators. The tour operators will contact the winners as soon as they have received the winners’ details from the Operator. Unless otherwise agreed, winners must start and complete the trip on the specified date or during the specified period. If winners do not meet this deadline or time period, they are no longer entitled to the prize and the claim against the Operator expires. Once winners confirm the trip, it is subject to the applicable travel conditions of the tour operator. Unless otherwise agreed, winners shall bear their own travel costs to and from the starting point of the trip (e.g. airport, train station, hotel), as well as any subsequent costs. Furthermore, winners are responsible for all private costs (e.g. minibar, insurance, food, minibar) incurred during the trip.
A cash payout or replacement of winnings is not possible. Claims to prizes are not transferable to other persons. If events are canceled or companies are liquidated, the winnings are forfeited without entitlement. In the event of delivery bottlenecks or non-availability of the prize, the Operator is entitled to hand over a substitute prize that essentially corresponds to the original prize.
Prizes will be forfeited if the winner does not respond to the prize notification within a reasonable period of time (maximum 48 hours). In the event of expiry, the Operator may appoint a new winner.
All winnings are personal. The Operator reserves the right to issue warnings to the winners concerned in the event of suspected infringements and the prizes will be forfeited in such cases. Furthermore, the Operator reserves the right to exclude the persons concerned from future competitions.

6. Disbursements

The Operator levies a 35% withholding tax on cash winnings and cash-like winnings (e.g. vouchers) in excess of CHF 1,000 before transferring the winnings. Winners will receive a confirmation from the Operator to reclaim the withholding tax, which winners must enclose in their own tax return. Winners must declare winnings in excess of CHF 1,000 in their own tax return.
Gains in kind (e.g. appliances, furniture) that exceed CHF 1,000 must be declared by the winners in their tax returns. For these non-cash prizes, the Operator requires a confirmation of residence from the winners, which must be sent to the Operator within 10 working days. If the confirmation of residence is not delivered within 10 working days, the prize will be forfeited without entitlement to compensation or any other claim. The costs for the confirmation of residence are borne by the winners themselves.

7. Data protection

Participation in competitions is voluntary. By taking part in the competition, participants consent to their personal data being processed for the purposes of the competition. This includes, among other things, the transfer of personal data to cooperation partners as part of the competition.
Participants agree that their name and image may be published on the Operator’s website and social media channels if they win.

8. Liability

The Operator is released from all obligations when the prize is handed over or delivered to the winners, or subitted to the postal office. The Operator is not liable for loss, delay or damage to the prizes caused by post or transportation or other circumstances beyond the control of the Operator.
The announcement of winners is without guarantee.
The Operator accepts no liability for late, lost, damaged, incorrect or misdirected participations. The Operator also accepts no liability for technical difficulties that could affect the final results of the competition or participation.

9. Miscellaneous

Legal recourse is excluded.
No correspondence is entered into.
All costs, taxes or fees in connection with winnings are borne by the winners.
The Conditions of Participation are subject exclusively to Swiss law.
If individual provisions of the Conditions of Participation are or become invalid, this shall not affect the validity of the remaining provisions.
The Conditions of Participation may be changed by the Operator at any time, without prior notice and without separate notification. The current version of the Conditions of Participation applies in each case.
